Spouses and parents of US citizens who are applying for a waiver in Ciudad Juarez or in their home country would not be barred from reentry for three to ten years
The UFW Foundation supports the Department of Homeland Security’s planned rule change regarding waivers of inadmissibility for certain immigrant relatives of U.S. Citizens. This change will benefit the spouses, children, and parents of American citizens who have overstayed their visas or who have remained in the United States after an unlawful entry, and who can prove through a waiver application that their inability to obtain permanent resident status would cause extreme hardship to a U.S. Citizen spouseor parent. The change will facilitate the waiver application process for spouses and children of U.S. citizens subject to the three or ten-year bar to admission by allowing them to apply for a waiver of inadmissibility in the United States before exiting the country.
The UFW Foundation has observed that many family members of U.S. Citizens choose not to apply for permanent residence for fear of being separated from their families in the U.S. for an extended period of time. Under the new rule, certain family members of American citizens who require waivers of the three-or ten-year bars would still have to return to their home country to a U.S. consulate for processing, but could apply to have their hardship waiver adjudicated in the United States before leaving. This will reduce the amount of time that Americans are separated from their immigrant family members during the waiver application process.
